There are three types of divorce in Japan;
(1)Divorce by agreement(Kyougi Rikon): Divorce, based on mutual agreement
(2)Divorce by mediation in family court(Choutei Rikon): Divorce, granted through mediation in a family court
(3)Divorce by judgement of district court(Saiban Rikon): Divorce through an application to a district court for a decision
Who can divorce in Japan
If Japanese law is applicable to your case, you can divorce in Japan. Usually, Japanese law is applicable to the following cases;
(1) one of the married couple is a Japanese national and lives in japan
(2) nationality of both of the married couple is Japanese
(3) both of the married couple live in Japan
(4) the married couple is closely related to Japan
Divorce with Children
In case Japanese law is applicable, custody of minor children is determined by Japanese civil law.
Japanese civil law doesn’t allow joint custody and therefore, one of the couple will be a solo custodial of the children.
Problems associated with divorce
